Terms of sale

1. Scope of Application

These terms and conditions of sale apply to all orders placed on the website acidcobra.eu operated by AC Rec., a micro-entrepreneur. Any order implies full and unconditional acceptance of these terms and conditions of sale.

2. Products

AC Rec. offers for sale new, sealed vinyl records and CDs (Compact-Disc). The products are described with the maximum possible accuracy. The photographs and visuals presented are non-contractual and may show slight variations from the actual product.

Pre-orders: Some products may be offered for pre-order. In this case, this information is clearly indicated in the product description. The delivery time for pre-orders is 30 business days from the product's release date.

3. Availability

Our product offers are valid within the limits of available stock. In the event of a product's unavailability after your order has been placed, we will inform you as soon as possible and offer you either a full refund or an equivalent replacement product.

4. Price

Prices are indicated in euros (EUR) and are valid at the time the order is placed. As a micro-entrepreneur benefiting from the VAT exemption scheme (Article 293 B of the French General Tax Code, our prices are exempt from VAT.

The displayed prices only include the cost of the product. Shipping costs are calculated separately and indicated before the final validation of your order.

We reserve the right to modify our prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.

5. Ordering

To place an order, you must:

• Select the desired products and add them to your cart

• Check the contents of your cart

• Enter your delivery and billing information

• Choose your delivery method

• Validate your order and proceed to payment

The validation of your order constitutes acceptance of these terms and conditions of sale and serves as proof of the sales contract.

6. Order Confirmation

Once your order is validated and payment is confirmed, you will receive a confirmation email summarizing the details of your order. We invite you to check the accuracy of the information and contact us immediately in case of any error.

7. Payment

Payment is made online at the time of the order using the payment methods offered on the site (credit card, etc.). Payment is secured.

Your order will only be processed after validation and receipt of the payment. In case of payment refusal by banking institutions, the order will be automatically cancelled.

8. Delivery

The delivery terms are detailed in our Shipping Policy. The order processing time is 2 to 3 business days (or 30 business days for pre-orders). The estimated delivery time is 7 business days throughout the European Union.

The transfer of ownership and risks occurs upon handover of the product to the carrier. It is your responsibility to check the condition of the package upon receipt and to make any necessary reservations with the carrier in case of apparent damage.

9. Right of Withdrawal

In accordance with Articles L221-18 and following of the French Consumer Code (Code de la consommation), you have a period of 14 days from the receipt of your order to exercise your right of withdrawal without having to justify your reasons or pay penalties.

Conditions: Records must be returned in their original, cellophane-sealed packaging. Records whose seal has been broken cannot be returned, in accordance with Article L221-28 of the French Consumer Code regarding unsealed audio recordings.

Exception: In the event of a defective or non-conforming product, the return is accepted even if the packaging has been opened. In this case, we offer an exchange and cover the return shipping costs.

10. Legal Guarantees

All our products benefit from the following legal guarantees:

Legal guarantee of conformity (Articles L217-4 to L217-14 of the French Consumer Code): You have a period of 2 years from the delivery of the good to act. You can choose between repair or replacement of the good, subject to the conditions provided by law.

Guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code (Code civil)): You can choose between cancellation of the sale or a reduction in the sale price.

11. Liability

AC Rec. undertakes to implement all necessary means to ensure the proper execution of orders. Our liability cannot be engaged in case of force majeure or an event beyond our control (carrier strikes, natural disasters, etc.).

12. Intellectual Property

All elements of the site (texts, images, logos, trademarks) are protected by intellectual property law. Any reproduction, representation, or use, total or partial, without prior authorization is prohibited.

13. Protection of Personal Data

Personal data collected during your order are necessary for its processing and delivery. In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, delete, and object to the processing of your data. For more information, consult our Privacy Policy.

14. Mediation and Dispute Resolution

In accordance with Article L612-1 of the French Consumer Code, we offer a consumer mediation system. In case of a dispute, you can submit your complaint on the dispute resolution platform set up online by the European Commission: https://ec.europa.eu/consumers/odr/

You can also use any consumer mediator registered on the list established by the Commission for the Evaluation and Control of Consumer Mediation.

15. Applicable Law

These terms and conditions of sale are subject to French law. In the event of a dispute and in the absence of an amicable agreement, the dispute will be brought before the competent French courts.

16. Modification of Terms

AC Rec. reserves the right to modify these terms and conditions of sale at any time. The applicable conditions are those in effect on the date of the order.
